Terms of Service
1. Who we are and what these terms cover
1.1 Walkshed ("Walkshed", "we", "us", "our") is a London neighbourhood-research tool operated by [LEGAL / TRADING NAME], established in England and Wales. You can contact us at hello@walkshed.app.
1.2 These Terms of Service ("Terms") form a legally binding agreement between you and us governing your use of the Walkshed website at walkshed.app, the map, scores, data, and any paid plan (together, the "Service").
1.3 By creating an account, pairing with a partner, or buying a plan, you confirm you have read, understood, and agree to these Terms, the Disclaimer, and the Privacy Policy, each of which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility
2.1 You must be at least 18 and able to form a binding contract.
2.2 The Service is provided for personal, non-commercial use to help you research where to live. Commercial, professional, or resale use (including by estate agents, buying agents, relocation firms, or developers) requires a separate written licence from us — contact us.
3. Your account and couple pairing
3.1 You are responsible for your account credentials and for all activity under your account. Tell us promptly at hello@walkshed.app if you suspect unauthorised use.
3.2 Couple pairing. Walkshed lets you link your account with a partner so you can share a shortlist, comparison, and weighting. When you pair, each partner can see the shared workspace, including saved addresses, commute locations, shortlisted areas, and weighting preferences. Only pair with someone you trust with that information. Either partner may unpair at any time; on unpairing we stop sharing newly created data between the accounts, and each account retains the shared data that existed at the time of unpairing unless you ask us to delete it (see the Privacy Policy).
3.3 You must not create an account using another person's details without their permission, and you must not enter a third party's home or work address without a lawful basis for doing so.
4. What the Service is — and what it is not
4.1 Walkshed aggregates publicly available data and our own calculated scores to help you compare and shortlist neighbourhoods. It shows, among other things, walkability and commute scores, indicative crime, school (Ofsted), public-transport accessibility (PTAL), flood-risk, council-tax-band, demographic, and indicative property-price signals for areas of London.
4.2 The Service is information and research only. It is not advice. In particular, Walkshed does not provide and must not be relied on as:
- financial, investment, or mortgage advice (we are not authorised or regulated by the Financial Conduct Authority);
- property valuation, surveying, conveyancing, planning, or legal advice;
- a guarantee of school admission, transport service, safety, flood outcome, price, or any future result;
- a substitute for your own professional due diligence (surveys, searches, valuations, legal advice, and your own visits to an area).
4.3 The data is third-party, aggregated, approximate, and may be incomplete, out of date, or wrong. The full, dataset-by-dataset caveats are set out in the Disclaimer, which you must read. Decisions you make using the Service are your own, and you are solely responsible for them.
5. Disclaimer (summary)
To the maximum extent permitted by law, the Service, the scores, and all data are provided "as is" and "as available", without warranties of accuracy, completeness, fitness for a particular purpose, or that the Service will be uninterrupted or error-free. The full Disclaimer governs and is incorporated into these Terms. Nothing in this section limits the statutory rights you have as a consumer (see section 14).
6. Plans, passes, and pricing
6.1 Parts of the Service are free. Premium features (such as the second partner's commute, the full weighting panel, full area and demographic data, shortlist and compare, family-travel targets, saved state, and the Move Report) require a paid plan.
6.2 We currently offer a 90-day Walkshed Plus pass (a single, non-recurring payment that unlocks premium features for 90 days), a monthly Walkshed Plus subscription (a recurring payment that renews automatically until cancelled — see section 7), and the Move Report (a single payment for a one-off downloadable report).
6.3 Prices are shown at checkout in pounds sterling and include any applicable tax. Payments are processed by our merchant-of-record payment provider, Paddle, who sells the plan to you as reseller, handles billing, and is responsible for charging and remitting sales tax / VAT. By purchasing you also agree to their buyer terms.
6.4 We may change prices, plans, and what each plan includes. Changes do not affect a pass you have already bought (it runs its 90 days on the terms you bought it under) or the current paid month of a subscription. For subscriptions, we will give at least 30 days' notice of a price change before it applies to a future renewal.
7. Auto-renewal of subscriptions
7.1 If you choose the monthly subscription, it renews automatically at the then-current price each month, and your payment method is charged, until you cancel. The 90-day pass does not renew — it simply expires.
7.2 We (or our payment provider) will make renewal terms clear at checkout and send any reminders required by law.
8. Cancellation and refunds
8.1 Subscriptions. You can cancel the monthly subscription at any time from your account or by emailing hello@walkshed.app. Cancellation stops the next renewal; you keep access until the end of the month already paid for. We do not provide pro-rata refunds for a partial month except where required by law.
8.2 Statutory 14-day cancellation right and your consent to immediate access. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a purchase of digital content or services bought online. When you buy a pass, subscription, or Move Report, you expressly ask us to give you immediate access and you acknowledge that you therefore lose the 14-day right to cancel once we have started supplying the digital content / service. We make you confirm this at checkout.
8.3 Goodwill. Even where we are not legally required to, we may at our discretion refund a recent purchase if you have made little or no use of it — contact us within 14 days and we will look at it fairly.
8.4 Nothing in this section removes your statutory rights, including your right to a refund or repeat performance if the digital content is faulty, not as described, or not of satisfactory quality under the Consumer Rights Act 2015.
9. Acceptable use
9.1 You agree not to:
- scrape, harvest, bulk-download, cache, or systematically extract the data, scores, or compiled database, whether manually or by any automated means (bots, crawlers, scripts), except as the Service intends for ordinary personal browsing;
- resell, sublicense, redistribute, or commercially exploit the Service, the scores, or the underlying compiled database;
- reverse engineer, decompile, or attempt to derive our scoring methodology or database other than as permitted by law;
- use the Service to break any law, to infringe anyone's rights, or to upload unlawful, infringing, or harmful content;
- attempt to gain unauthorised access to the Service, other accounts, or our systems, or interfere with their security or operation.
9.2 No unlawful discrimination. The Service exposes area demographic signals (for example owner-occupier, household-composition, and area-classification data). You must not use Walkshed, its filters, or its data to discriminate against any person contrary to the Equality Act 2010 or any other law, including in connection with letting, selling, employment, or services. These signals are provided to help you understand an area's character, not to target or exclude people.
9.3 We may suspend or terminate access that breaches this section (see section 15).
10. Intellectual property and data rights
10.1 The Walkshed name, the website, its design, software, the calculated scores, and our selection, arrangement, and compilation of the underlying data (a database in which we hold database rights under the Copyright and Rights in Databases Regulations 1997) are owned by us or our licensors and are protected by intellectual-property law. Except for the limited right to use the Service under these Terms, no rights are granted to you.
10.2 The underlying source datasets remain the property of, and licensed by, their original publishers under their own terms (see section 11). Your right to use those datasets via the Service does not transfer any rights in the original datasets to you.
10.3 Your content. Addresses, commute locations, shortlists, weightings, and similar inputs remain yours. You grant us a non-exclusive, royalty-free licence to host, process, and display that content only as needed to provide the Service to you and any partner you pair with, and as described in the Privacy Policy.
11. Third-party services and data sources
11.1 The Service relies on third parties, including our payment provider (Paddle) and our map and geocoding provider (MapTiler, using OpenStreetMap data). When you type an address, it is sent to our geocoding provider to convert it to a location. Your use of those features is also subject to those providers' terms, and we are not responsible for their services.
11.2 Walkshed contains public sector and other third-party information, including data made available under the Open Government Licence v3.0. Attributions include, without limitation:
- Police recorded-crime data — Crown copyright and database right, via data.police.uk, Open Government Licence v3.0;
- School data — Ofsted and the Department for Education (Get Information About Schools), Open Government Licence v3.0;
- Public Transport Accessibility Levels (PTAL) — Transport for London / London Datastore;
- Flood-risk data — Environment Agency copyright and/or database right;
- Council-tax band data — Valuation Office Agency, Open Government Licence v3.0;
- Census 2021 and Output Area data — Office for National Statistics, Open Government Licence v3.0; and area classification, CDRC;
- Map tiles and geocoding — MapTiler and OpenStreetMap contributors, ODbL.
11.3 We make commercially reasonable efforts to comply with, and attribute under, each dataset's licence. We do not claim ownership of these underlying datasets.
12. Availability and changes to the Service
12.1 We try to keep the Service available but do not guarantee it will be uninterrupted, timely, secure, or error-free. We may change, suspend, or discontinue any part of the Service, or refresh, add, or remove datasets, at any time. Data is refreshed periodically and may lag its original source.
13. Privacy
13.1 We process personal data (including your email, and the home/work addresses and commute locations you enter) in line with the Privacy Policy and UK data-protection law. We are registered with the Information Commissioner's Office under registration [ICO REGISTRATION REF].
14. Limitation of liability
14.1 Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; and any of your statutory rights as a consumer (including under the Consumer Rights Act 2015) that cannot be excluded or limited.
14.2 Subject to section 14.1, and because the Service is an information and research tool that you do not pay for with your home-buying or renting decision:
- we are not liable for any decision you make, or refrain from making, in reliance on the Service, including any decision to view, offer on, rent, buy, sell, or move to or from any property or area;
- we are not liable for the accuracy, completeness, or timeliness of any data, score, estimate, or third-party content, or for any loss arising from it being wrong, missing, or out of date;
- we are not liable for indirect or consequential loss, or for loss of profit, loss of opportunity, loss of anticipated savings, financial loss on a property transaction, or loss of or damage to data, in each case whether or not foreseeable; and
- our total liability to you arising out of or in connection with the Service and these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the greater of (i) the total amount you paid us in the 12 months before the event giving rise to the claim, and (ii) £100.
14.3 You accept that the price of the paid plans reflects this allocation of risk, and that the limits in section 14.2 are reasonable given the free / low-cost, informational nature of the Service.
15. Suspension and termination
15.1 You may stop using the Service and close your account at any time.
15.2 We may suspend or end your access (including any paid plan, without refund where you are in serious or repeated breach) if you breach these Terms, section 9 (Acceptable use) in particular, or where we reasonably need to for legal, security, or operational reasons. Where fair to do so we will give notice.
15.3 Sections that by their nature should survive termination (including sections 4–5, 10–11, 14, and 16–17) continue to apply.
16. Governing law and disputes
16.1 These Terms and any dispute arising from them are governed by the law of England and Wales.
16.2 You and we submit to the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts and rely on the mandatory consumer-protection law of your home nation.
16.3 If you have a complaint, please contact us first at hello@walkshed.app — we aim to resolve issues quickly and fairly.
17. General
17.1 Changes to these Terms. We may update these Terms from time to time. If a change materially affects you, we will give reasonable notice (for example by email or an in-app notice) before it takes effect for your continued use. Continuing to use the Service after a change means you accept the updated Terms.
17.2 Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of our business, provided your rights are not reduced.
17.3 Entire agreement. These Terms, the Disclaimer, and the Privacy Policy are the entire agreement between us about the Service.
17.4 Severability. If any provision is found unenforceable, the rest continues in force.
17.5 No waiver. A delay in enforcing these Terms is not a waiver of our rights.
17.6 Third parties. Except for a partner you pair with (who benefits from the shared-workspace provisions) and our licensors where stated, no one other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
